Definitions
The ‘Company’ Charter-a
the ‘Charterer’ Any person, firm or body corporate chartering,
The ‘Aircraft’ Any aircraft which is the subject of the charter agreement between the Carrier and the Charterer.
The ‘Flight Schedule’ The place of departure, place of destination and any stopping points together with any indications of departure and arrival times between the Carrier and the Charterer.
The ‘Agreement’ Any agreement between the Carrier and the Charterer for the charter of aircraft from the Carrier.
1. The Company shall provide for the Charterer’s use the aircraft, manned and equipped for the performance of the Flight Schedule.
Should the Aircraft for any reason ( whether before or after commencement of the Flight Schedule ) become incapable of undertaking or continuing all or part of the Flight Schedule, the Company may, at its discretion, substitute therefore one or more aircraft of the same or another type and the provisions of the Agreement shall apply mutates mutandes to the substituted aircraft. If the Company does not substitute another aircraft it shall not be under any liability to the Charterer and the Charterer shall remain liable to pay for that part of the Flight Schedule (if any) that has been performed at the time the Aircraft becomes incapable.
The captain of the Aircraft shall have absolute discretion to:
refuse passenger(s), baggage, cargo or any part thereof;
decide what load may be carried on the Aircraft and how it shall be distributed;
decide whether and when a flight may be safely undertaken and where and when the Aircraft should be landed.
The Company shall use all reasonable endeavours to complete the Flight Schedule but shall be entitles without liability to depart from the Flight Schedule if necessary in its opinion and any additional expenses ( including fees such as landing, handling, parking, navigation, ground support service, customs and airport surcharges ) shall be borne by the Charterer. Additional cost incurred for deviation due to weather conditions will also be borne by the Charterer.
The Company is entitled to cancel your booking if a cancellation of a flight schedule is necessary due to adverse weather conditions to prevent flying or filming, CAA regulations, mechanical problems amounting to non-availability of aircraft, If the company cancels your flight for any of these reasons, they will notify the signatory to the confirmation order of the cancellation and, wherever possible the reason, without unreasonable delay. If the company cancels your flight for any of these reasons the Company will refund in full any money paid in relation to the price of the flight and will reschedule if you so require. Such refunds will be made to the signatory of the booking confirmation order
If for any reason the Aircraft is diverted from any airfield or destination shown in the Flight Schedule to another airfield, the journey to the said airfield or destination shall be deemed to be complete when the Aircraft arrives at the other airfield.
No servant, agent or representative of the Company has authority to modify or waive any provision of the Contract.
Cancellation Charges:
i. With immediate effect: 10% of quote
ii. Less than 7 days notice: 25% of quote
iii. Less than 2 days notice: 75% of quote
iv. On the day / no show: 100% of quote
(Please note that Battersea Heliport landing fees and Silverstone Heliport Landing fees are non refundable)
Major Sporting Events:
Royal Ascot – Cheltenham Festival – Epsom Derby – British Grand Prix – Open
Golf – Goodwood Events IFS – Revival – Corporate Events
1. Bookings made for major sporting events are subject to a 75% cancellation fee.
2. If a booking has been made and confirmed by e-mail, fax or letter, two (2)
months prior to the event then this is an acceptance of our terms and condition
3. At major events there is always a shortage of helicopters, pilots and a limited
availability of landing slots. As a consequence, aircraft, crew and landing fees
are subject to advanced payment.
9 Payment Terms:
Non-account holders are required to secure payment of declared funds by bank transfer, cheque or credit card prior to the flight taking place. Credit Cards accepted by arrangement (2.5% fees applies). 5% above base rate charged for late payments. See confirmation booking form for payments due
